Dean Dunham answers all your finance questions including a reader who asked whether you could make a claim if a pothole damaged your car while driving on a private road.

I recently drove down a private road which was in poor condition and my front wheel caught a pothole. It’s damaged my car and now I face a big repair bill. The growing number of potholes are causing more and more damage to vehicles, but if it happens on a private road, can you claim for any problems they cause?

Instead, responsibility for the private road lies with the person or entity that owns the road. The rules for private roads are set out in the Occupiers Liability Act 1984 for England and Wales; the Occupiers’ Liability Act 1957; and the Occupiers’ Liability Act 1960 in Scotland. However, when the road is owned by a private individual and leads to or past their private property it can be more tricky. You should, therefore, also consider whether it would be easier to make a claim on your car insurance, although this could affect your premium.
