Nike's use of noncompetes threatens to stifle hiring at rivals and startup sneaker brands

Some former Nike workers remain subject to them.On February 7, President Joe Biden used the pulpit of the State of the Union to argue for the elimination of noncompete agreements, saying it's not fair that a"cashier at a burger place can't walk across town and take the same job at another burger place to make a few bucks more."

The same day Biden spoke to the nation, at least three former Nike workers were waiting for their noncompete agreements to end, according to a search of LinkedIn profiles. "If I'd been sitting at that speech, I would've probably stood up to clap at those comments," Peter Bragdon, the general counsel for Columbia Sportswear, told Insider."This industry is very aggressive with noncompetes.

The former Nike workers who noted recent noncompete agreements on their LinkedIn profiles either declined Insider's requests for comment or didn't return LinkedIn messages.Having worked at Nike for at least eight years, each is an industry veteran, but none are at the upper-management level traditionally associated with noncompete agreements.

"I was an advocate for starting to use them here," he said."And it was really because of the aggressive, and I would say overreaching, use of noncompetition agreements within our industry."He said Columbia typically enforces noncompetes for six months, not the"We were seeing agreements that for 12 months people weren't getting paid," he said."That's crazy.
